Divorce Mediation: Yes, Avoiding Court IS Possible

What is Divorce Mediation?

Divorce Mediation involves a series of meetings where the two divorcing spouses and the attorneys of Peter L. Cedeno Associates sit around a table and discuss everything involved in getting a divorce. During the mediation sessions, our office will help walk the couple through their divorce. We will inform them of all of the necessary items they must tackle in order to obtain a divorce – and we will inform them of the law involved so they know what their guideposts should be and are able to make informed decisions.

In essence, we will help them understand the divorce process and negotiate the terms of a formal separation agreement and divorce. For example, what will the parenting plan be? Will child support or spousal support be necessary? What might a court award in either of those situations under their specific circumstances? How will they deal with their assets and liabilities? Who gets the house? Who gets the time share in the Bahamas? What are the tax implications of a final divorce judgment? What are the healthcare implications?

Getting a divorce can prove to be a very complicated process with many varying factors playing a part. But it doesn’t have to be made even more complicated by hiring separate attorneys and going to battle in court. Many divorcing couples will find that mediation is a much better alternative to litigation – one which saves them tons in terms of money, time, and emotional expenditure.

Mediation is charged at an hourly rate, a rate will depend on your specific circumstances but typically ranges from $250-$450 per hour. Keep in mind that most prominent NY divorce attorneys charge around $400-$500 per hour – and in litigation, those hours add up much more quickly than they do in mediation, the latter of which goes according to your own clock.
