Social Media And Divorce

Everything these days winds up in one social media context or another. People post pictures of their coffee to Instagram, Tweet their thoughts on a traffic jam, give detailed explanations about their dinner on Facebook, and more. While it is great to be able to connect so readily with friends and strangers all around the world, there are some matters that should not be shared so openly, especially when it comes to divorce proceedings.

If you are going through a divorce, you need to be acutely aware of everything you say on social media, because there is bound to be someone dissecting your words in an unfavorable light. Although your posts most likely cannot be used directly as evidence in divorce court, there is nothing to stop your soon-to-be ex-spouse from spinning them to their advantage.

Let’s take a look at a few examples to put it into perspective:

  • Frivolous spending: If you are vying for spousal support to be sent your way each month, you should not be uploading images of great expenditures or vacations. It could be seen as frivolous by the court and proof that you actually do not need any financial support.
  • Questionable behavior: The presiding judge has to rule in favor of the “child’s best interests” in every divorce case; usually this boils down to finding the most responsible and mature of the parents. Videos of you engaging in wild parties or posts talking about illicit activities are probably going to be seen as undesirable social behavior and could seriously hurt your chances of gaining custody of your children.
  • New romantics: As understandably exciting as it may be for you to continue on with your life and look for another companion, it could even be argued that providing social information about a new significant other could have negative impacts on your divorce case. Your ex might spin it as showing that you were never committed to the relationship and should therefore be rewarded with less in the end.

When all is said and done, you should exercise a little more caution when posting to social media while going through a divorce. Each and every one of us could probably benefit from a tad bit more common sense as well. Remember that your future stability is hanging in the balance, and sharing some gossip with your friends is not worth jeopardizing it.
